1. Introduction

Welcome to Servch. These Terms and Conditions govern your use of our website and services located at servch.co.uk (the "Platform").

Servch is a booking platform that connects customers with independent service providers across the United Kingdom. By accessing or using our Platform, you agree to be bound by these Terms. If you do not agree, please do not use our services.

The Platform is operated by IdeaToWeb, a company registered in England and Wales. Company number 16908716. Servch is a service/brand operated under IdeaToWeb.

2. Definitions

  • "Platform" refers to the Servch website, mobile applications, and all related services.
  • "Customer" refers to any user who books services through the Platform.
  • "Provider" or "Service Provider" refers to any business or individual offering services through the Platform.
  • "Booking" refers to an appointment or service reservation made through the Platform.
  • "User" refers to any person who accesses or uses the Platform, whether as a Customer or Provider.

3. Eligibility and Account Registration

3.1 Eligibility

You must be at least 18 years old to create an account and use the Platform. By registering, you confirm that you meet this requirement.

3.2 Account Responsibilities

When you create an account, you agree to:

  • Provide accurate, truthful, and complete information
  • Keep your login credentials secure and confidential
  • Notify us immediately of any unauthorised access to your account
  • Accept responsibility for all activity under your account
  • Not create multiple accounts for fraudulent purposes

We reserve the right to suspend or terminate accounts that violate these terms.

4. Platform Services

4.1 For Customers

The Platform enables Customers to:

  • Search and discover local service providers
  • View provider profiles, services, pricing, and availability
  • Book appointments online 24/7
  • Receive booking confirmations and reminders via email
  • Message providers directly through the Platform
  • Cancel or reschedule bookings (subject to provider policies)
  • Make secure online payments (when enabled)

4.2 For Service Providers

The Platform enables Providers to:

  • Create a professional business profile and booking page
  • List services with pricing, descriptions, and duration
  • Set availability, working hours, and time off
  • Manage bookings and customer appointments
  • Add team members with individual schedules
  • Set custom cancellation, refund, and rescheduling policies
  • Accept online payments (when enabled)
  • Communicate with customers via messaging
  • Create a custom subdomain booking page (e.g., yourbusiness.servch.co.uk)
  • Embed booking widgets on external websites

5. Bookings

5.1 Booking Contract

When a Customer makes a booking, they enter into a direct contract with the Service Provider, not with Servch. We act solely as an intermediary platform facilitating the connection between Customers and Providers.

5.2 Booking Confirmation

Bookings may be confirmed in one of two ways, depending on the Provider's settings:

  • Instant Booking: The booking is confirmed immediately
  • Manual Approval: The Provider must approve the booking before it is confirmed

Customers will receive an email confirmation once the booking is confirmed.

5.3 Group Bookings

The Platform supports group bookings where multiple people can be booked for the same or different services. Each person in a group booking is treated as an individual booking for cancellation and refund purposes.

5.4 Staff Selection

Where a Provider has multiple team members, Customers may be able to select a specific staff member for their booking. Staff availability affects available time slots.

6. Payments

6.1 Pricing

All prices on the Platform are displayed in British Pounds (GBP). Providers set their own service prices, which are clearly displayed before booking.

6.2 Online Payments

When online payments are enabled, payments are processed securely through Stripe. Customers can pay using credit card, debit card, Apple Pay, or Google Pay.

Payment options set by Providers include:

  • Pay Now: Full payment or deposit required at time of booking
  • Pay Later: Card details saved, charged on the day of the appointment
  • Pay at Location: No online payment required; pay the Provider directly

6.3 Deposits

Some Providers may require a deposit at the time of booking. The remaining balance is then paid at the location or charged on the day of the appointment.

6.4 Platform Fees

Servch offers a free plan with no commission on bookings. Premium subscription plans are available for Providers who require additional features.

7. Cancellations and Refunds

Cancellation and refund policies are set by each individual Service Provider and are displayed during the booking process.

  • Refund Window: Providers set the minimum notice required for a full refund (e.g., 24, 48, or 72 hours before the appointment)
  • Late Arrivals: Providers set a late arrival threshold after which no refund is available
  • No-Shows: Failure to attend an appointment without prior cancellation typically results in no refund
  • Provider Cancellations: If a Provider cancels a booking, the Customer receives a full refund

8. Provider Responsibilities

Service Providers agree to:

  • Provide accurate and truthful information about their business and services
  • Set realistic availability and honour confirmed bookings
  • Deliver services as described in their listings
  • Maintain professional standards and treat customers with respect
  • Respond to customer messages and enquiries in a timely manner
  • Comply with all applicable UK laws and regulations
  • Hold appropriate licences, qualifications, and insurance for their trade
  • Set clear and fair cancellation, refund, and rescheduling policies
  • Not discriminate against customers based on protected characteristics

9. Customer Responsibilities

Customers agree to:

  • Provide accurate contact information and booking details
  • Arrive on time for appointments
  • Review and agree to the Provider's cancellation policy before booking
  • Pay for services as agreed
  • Treat Providers and their staff with respect
  • Cancel or reschedule bookings in advance if unable to attend
  • Leave honest and fair reviews
  • Not engage in abusive, threatening, or inappropriate behaviour

10. Prohibited Activities

Users of the Platform must not:

  • Use the Platform for any unlawful purpose
  • Provide false or misleading information
  • Impersonate another person or business
  • Harass, threaten, or abuse other users
  • Attempt to circumvent payment systems or defraud Providers or Customers
  • Post offensive, defamatory, or inappropriate content
  • Scrape, copy, or reproduce content from the Platform without permission
  • Attempt to interfere with the Platform's operation or security
  • Create fake reviews or manipulate ratings
  • Use the Platform to solicit business outside of the Platform to avoid fees

Violations may result in immediate suspension or termination of your account.

11. Intellectual Property

All content on Servch, including but not limited to the website design, logos, graphics, text, and software, is owned by Ideatoweb Ltd or its licensors and is protected by UK intellectual property laws.

You may not reproduce, modify, distribute, or create derivative works from any content on the Platform without prior written permission.

Providers retain ownership of their own business content (photos, descriptions, etc.) uploaded to the Platform.

12. Disclaimers and Limitation of Liability

12.1 Platform Role

Servch is a marketplace platform. We do not:

  • Employ or directly control Service Providers
  • Provide, perform, or guarantee the quality of any services listed
  • Verify the qualifications, licences, or insurance of Providers (though we encourage Providers to maintain these)
  • Guarantee the accuracy of listing information

12.2 Disclaimer

The Platform is provided "as is" without warranties of any kind, either express or implied. We do not warrant that the Platform will be uninterrupted, error-free, or free of viruses.

12.3 Limitation of Liability

To the maximum extent permitted by law, Servch and its directors, employees, and affiliates shall not be liable for:

  • Any indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, data, or business opportunities
  • Any damages arising from the conduct of Providers or Customers
  • Any issues with services provided by Service Providers

Our total liability for any claim shall not exceed the amount paid by you to us (if any) in the 12 months prior to the claim.

13. Indemnification

You agree to indemnify and hold harmless Servch, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from:

  • Your use of the Platform
  • Your violation of these Terms
  • Your violation of any rights of a third party
  • Your provision or receipt of services through the Platform

14. Dispute Resolution

14.1 Between Users

Disputes between Customers and Providers should first be resolved directly between the parties. You can message the other party through the Platform.

If you cannot resolve a dispute, you may contact our support team at support@servch.co.uk. We may assist in mediation but are not obligated to resolve disputes.

14.2 Governing Law

These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

15. Account Suspension and Termination

We reserve the right to suspend or terminate your account at any time if:

  • You violate these Terms and Conditions
  • You engage in fraudulent or illegal activity
  • You abuse or harass other users
  • You repeatedly receive negative feedback or complaints
  • We determine, in our sole discretion, that your continued use poses a risk to the Platform or its users

Upon termination, you lose access to your account and any associated data. Pending bookings may be cancelled.

16. Changes to Terms

We may update these Terms from time to time. When we make significant changes, we will:

  • Update the "Last updated" date at the top of this page
  • Notify registered users via email where appropriate

Your continued use of the Platform after changes are posted constitutes your acceptance of the updated Terms.
